The Subject


The Secretary of State for Health, Andrew Landsley, has announced that the UK Government will launch a consultation on the packaging of tobacco products in the spring of 2012. The consultation will examine in particular the issue of plain packaging, which has recently been implemented for cigarettes in Australia. This would mean stripping cigarette packs of graphics and get-up, leaving just the product name and Government health warnings.

Are the tobacco companies right to oppose such a measure based on their trade mark rights, and is this a sign of a wider attack on intellectual property rights? Will alcohol and fast food be next, or is tobacco a special case?

At a time when the consultation is expected to be live, we bring you two experts to debate the issues under the eye of a specialist member of the judiciary, in the congenial context of a TIPLO dinner.

Chairman, The Hon Mr Justice Richard Arnold 

Livio Vanghetti, Vice President Corporate Affairs EU, Philip Morris International
As a senior member of the Corporate Affairs team of Philip Morris in Europe, Livio Vanghetti has firsthand knowledge of the impact of packaging regulation on the tobacco industry. In what is expected to be a lively presentation, he will give a brand owner’s view on the impact that the imposition of plain packaging could have on its ability to manage and preserve the value of its trade marks.

Professor Sam Ricketson, Melbourne Law School, The University of Melbourne
Professor Sam Ricketson holds degrees from the Universities of Melbourne and London and is a Fellow of the Academy of Social Sciences of Australia. He has written, taught and advised widely in all areas of intellectual property law and is currently in the UK to write a book on the history of the Paris Convention. He will talk about a number of the IP issues thrown up by enforced plain packaging, including under the Paris Convention and TRIPS.
